Ministry of Environmental Protection: Industrial parks shall not be set up in environmentally sensitive areas

According to the website of the Ministry of Environmental Protection, the Ministry of Environmental Protection recently publicly solicited the Guiding Opinions on Strengthening Environmental Protection in Industrial Parks. According to the Opinions, industrial parks shall not be set up in environmentally sensitive areas.
The Opinions clearly stated that we should promote the establishment and improvement of the market mechanism for environmental services, and encourage the park to purchase environmental monitoring, pollution control and other third-party environmental services from the society. We will strengthen the publicity of environmental information, make public assessment information, guide public participation, and protect the environmental rights and interests of the people.
The Opinions require that the establishment of industrial parks must conform to the overall urban planning, the overall land use planning and the ecological environment protection planning, and should be connected with the main functional area planning and urban and rural planning. The layout should be reasonable according to the ecological red line and the requirements for the division of environmental functional areas, and should not be set up in environmentally sensitive areas.
The Opinions emphasized that the environmental impact assessment of the planning should be carried out in accordance with the law when the park is newly built, renovated and upgraded, and the preparation of the environmental impact assessment report of the development and construction planning should be organized.
The Opinions emphasized that each industrial park should establish environmental access conditions for new projects in the park according to regional environmental carrying capacity, total pollutant control indicators, resource and energy endowment, industrial foundation, market space, logistics and transportation and other conditions. Under the same conditions, support projects that are conducive to building an ecological industrial chain between enterprises to settle in the park.
The Opinions clearly stated that new, reconstruction and expansion projects should specify the source of total pollutant emission indicators, and should not give green light to enterprises entering the park in the name of "zero emission", "zero pollution" and other similar names.
The Opinions emphasized that the development of high water consumption and high pollution industries in water deficient areas, areas with serious water pollution and sensitive areas should be strictly controlled, and major pollutant emissions should be reduced and replaced for new, reconstructed and expanded construction projects in key industries such as paper making, coking, nitrogen fertilizer, nonferrous metals, printing and dyeing, agricultural and sideline food processing, API manufacturing, tanning, pesticide and electroplating.
The Opinions require that the park management organization should urge enterprises to strengthen the remediation of prominent environmental problems such as odor and noise. By the end of 2017, the industrial park should build centralized sewage treatment facilities as required and install automatic online monitoring devices. Beijing Tianjin Hebei, Yangtze River Delta, Pearl River Delta and other regions should be completed one year in advance.
The Opinions emphasized that industrial parks dominated by chemical industry, electroplating, medicine, metal smelting, lead battery and other industries should be regarded as hazardous wastes. In key areas of environmental supervision, the management organization of industrial parks should determine the list of key monitoring enterprises for hazardous wastes, and take effective measures to promote the reduction and recycling of hazardous wastes at the source.
The Opinions also requires strengthening the prevention and control of groundwater pollution in industrial parks. For industrial parks involving petrochemical production, storage and sales, mining, and landfill, necessary anti-seepage treatment should be carried out to prevent soil and groundwater pollution.
